Hey Hey!! my names Madame Bonbon. You may also address me as Truffles Bonbon or Truffles for short. My pronouns are She/her/they.welcome to my commissioning terms of service! I'm thrilled that you're considering working with me to bring your vision to life. Before we get started tho, I want to ensure that we're on the same page and that you understand my terms of service.
As a digital artist, I take pride in my work and strive to provide the best possible experience for my clients, and I'm here to help you bring your unique vision to life.
To ensure that our collaboration runs smoothly and that we're both happy with the final result, I have a few terms of service that I ask my clients to abide by.
These terms are designed to ensure clarity and protect the interests of both parties, it is essential that we establish an agreement regarding the terms of service. By continuing to use my products/services, you legally agree to be bound by the following terms:
Acceptance of Terms: By accessing, using, or interacting with my products/services, you acknowledge and agree to comply with all terms and conditions outlined in my Terms of Service document. This agreement constitutes a legally binding contract between you and me.Rights and Responsibilities: My Terms of Service define the rights and responsibilities of both parties, including the permitted use of my products/services, intellectual property rights, limitations of liability, privacy and data protection policies, and dispute resolution mechanisms.Updates and Modifications: My company reserves the right to update or modify the Terms of Service as needed, in order to adapt to changing circumstances or legal requirements. Commission process/Workflow
Comission process
- Fill out the commission form with all information and references be clear and to the point of what you want
- After sending me the filled form, I’ll ask for more details if needed and answer any question(s)!
- Then, after reviewing you form, I’ll come back to you within 24-48 hours to give you a quoted price.
- After finding you agree to the price you must agree to my Terms of Service to proceed.
- An invoice will be sent and upon confirmed payment you will be given the start & completion date, please note these are estimated dates that can change due to unforseen circumstances.
- I’ll start working on your commission once it is your turn on the queue. Please refer to the queue to see your place in line.
**please note if you are under a payment plan work will not be started until you are paid in full no exceptions will be made. **
Work Hours
I am available for contact during the normal business hours listed below. Please note I will be unreachable for updates during off hours, holidays, and sick days, a update will be given in advance if this is the case. Should i choose to work pass these hours listed below that is at my own discretion or if a rush fee was paid.Monday: 8am - 4pm

workflow
Step 1 or Thumbnailing/Sketch stage
I’ll sketch some ideas with black-and-white values, then show them to you so you can choose and/or tweak one to your liking.
You can expect anywhere from 1 to 4 thumbnails if I feel inspired and/or if artistic freedom is given to me.
Step 2 or Lineart stage
I’ll line the thumbnail of your choosing.
No wips are provided for this stage
Step 3 or Flat Color stage
I’ll put the base colors in, This is the final chance for corrections to be requested for your commission. This is what your commission will look like before I render it further.
Step 4 or Rendering stage
The most time-consuming part, there are no wips for this stage.
However, feel free to DM me to see the advancement.
Step 5 or Final effects
I’ll be adding effects and filters and finishing up.
Step 6 or Sending files
Finally, you will receive the finished artwork. You’ll receive two files, one with a watermark ment fo posting to social medias, and one without for personal use via email that was provided for payment, to not compress the quality. If the file is too big, I’ll use another image hosting website.
Once the commission is finished, no more changes or edits can be made.
If I have permission to post on social media, I’ll put a special watermark on it and reduce the sizing.
customer satisfaction
I will do everything I can to make my clients satisfied about their commission(s).
If you have any problem regarding the commissioned piece, please tell me right away, so we can find a solution together.
Your entire satisfaction is my end goal, so communication is the most important part of the commission process.
As such, if you have some issues with communication, please don’t hesitate to let me know beforehand, so I can adapt myself to you. Unfornately if you fail to communicate any issues you have til the work is done i will be unable to fix this without asking for further compensation so please promptly address issues during the appropiate stages.
REFUNDS & CANCELLATIONS
REFUNDS
When a commission is canceled for any reason and a refund is in order, you agree to adhere to the terms of service in whole listed below.
Refund Processing Timeframe
Please note that refund requests may take up to one month to be processed and returned to you. I strive to expedite this process as much as possible, but due to various factors involved, such as internal procedures, payment gateway protocols, and banking processes, a reasonable timeframe of one month has been established.
Determining the refund amount
A. a refund in the amount of 50% will be given should the commission be canceled at any time before a sketch has been sent to the customer for approval.B. a refund in the amount of 25% will be given should the commission be canceled at any time after the lineart + flat colors stage has been sent to the customer for approval.C. No refunds will be given once the lineart + flat color stage has been approved by the customerD. No refunds will be given once the commission has finished or thereafter.E. No refund will be given if the payment recieved was a tip for service
CANCELATIONS
Retention of Payment
Should the commission be canceled for any reason by either party, a portion of the payment amounting to no less then 50% will be retained by my company. This retention covers the costs and efforts invested in initiating the commission process, including administrative tasks, initial research, and resource and time allocation.
I understand that circumstances may arise where commission cancellation becomes necessary, and I strive to handle such situations with professionalism and understanding. I am always here to address any concerns or questions you may have regarding this policy.
Tips for service
When a payment is sent outside of a commission invoice or request it is considered a tip for services given. Services may include but are not limited to; streaming, entertaining, drawing requests, commissions, consultations, and therapeutic conversations. You agree these payments are non-refundable. I understand in the moment it can be exciting to be very charitable but because a service was provided during the time a payment was received a refund is not possible. You agree to follow my Terms of Service when handling disputes and chargebacks concerning tips.
Dispute Resolution
By proceeding with this transaction, you agree to the terms of service listed below with the handling of refunds and cancellations. You agree to handle any disputes or concerns under or about these terms of service or service rendered exclusively through the internationally binding arbitration provided by the designated platform ARB Inc. (https://www.net-arb.com/) This approach allows us to address and resolve any issues efficiently and fairly. You agree that any court may enforce the arbitration award.
Indemnification: customers agree to indemnify and hold me and my company harmless from any losses, expenses, or damages incurred as a result of unwarranted chargebacks initiated by them.Legal Disputes Not Subject to Arbitration Will Be Handled In New York ,NY, and Subject to New York Law.
I am solely based in New York, NY. For any action not subject to arbitration, you and I agree to submit to the personal jurisdiction of a state court located in New York, NY or the United States District Court for the Northern District of New York. The Terms and the relationship between you and I shall be governed in all respects by the laws of the State of New York, without regard to its conflict of law provisions.
Responsiblity for the Handling of Fees
As part of the dispute resolution process, it is important to note that you agree to assume responsiblity for any and all associated fees incurred during the resolution process. These fees cover administrative and processing costs necessary for impartial mediation and resolu
REVISIONS
Bust & Icon Illustrations: 2 revisions during sketch & base colour stage.

Chibi illustrations: 2 revisions during thumbnailing, base color stage

Halfbody & Fullbody Illustrations: 3 revisions during thumbnailing, base color stage

Animations: 5 revisions during thumbnailing, base color stage

Additional revisions after the steps stated previously will be charged 5-20% of base price, depending on complexity.
If you wish to change a part of the painting you have previously approved, I will charge you an extra fee.
In the case where artistic freedom is given, I will work based on my judgement. However, if the client requests a scrapping of the scene in its majority or entirety, they'll be charged for the difference discounted from artistic freedom commissions.
Any mistakes from my end will be fixed for free.

General guidelines
By commissioning me, you agree to have read and fully agreed to my terms of service as it pertains to both yours as the customer and mine as the artist rights and you are of legal age 18+.
I retain all the rights to my work, which include but are not limited to ;I do NOT authorize using any of my pieces as NFT.
Furthermore, I do NOT authorize using any of my pieces to feed any AI generator or use in an AI generator in any way.Right to Refusal: I reserve the right to refuse a commission request or cancel a commission at any time
with notice.Right to Reproduce: The right to control and authorize the reproduction of your artwork in various formats, such as prints, copies, or digital reproductions.Right to Display: The right to publicly display your artwork, whether in galleries, exhibitions, or online platforms and to determine how and where it is displayed. This also includes the use of the image as a sample for sales or self-promotion.Right to Distribute: The right to control and authorize the distribution of your artwork, including its sale, rental, or lending.Right to Derivative Works: The right to control and authorize the creation of derivative works based on your original artwork, such as adaptations, translations, or modifications.Right to Attribution: The right to be recognized and credited as the creator of your artwork, and to prevent others from falsely claiming authorship.Right to Integrity: The right to protect your artwork from any distortion, modification, or mutilation that may harm your reputation or the integrity of your work.Right to Privacy: The right to control the use of your name, image, or likeness associated with your artwork, and to protect your privacy in relation to the dissemination of personal information.Right to Fair Compensation: The right to receive fair and appropriate compensation for the use and exploitation of your artwork, especially in commercial contexts.Right to Limitation of Liability: In no case shall I, any hired or freelanced employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Customer rights
The customer reserves the right to:Claiming rights to the character, but not the digitial or physical art itself.Sharing/Reposting the artwork any place they see fit, with proper credit.Printing the artwork for personal use only.right to ask to purchase commercial and full rights to the artwork in question from the artist (a fee will apply)right to request that the commission remains private (a fee will apply)
payment plans
Should you find yourself in need of a payment plan it must be discussed beforehand. Once we agree on an amount, duration, and frequency of the payment plan, alterations will not be allowed unless extreme cases arises.
If you miss 3 of the agreed payments your commission will be canceled and a refund if any will be subject to the terms as stated in the refund policy.
Payment Plan Options
A non-refundable deposit of 50% must be put down in order to start a payment plan there will be NO exceptions to this rule fo new customers. An exception to this rule can be mad for returnng customers who have shown good standng with payment plansThe max length of a payment plan for ychs is 1 month as ychs are released the following monthThe max length of a payment plan for a commission of any kind is 2 months. An extension can be given for returning customers who have shown good standing with payment plansThe max length of a payment plan for an adopt or character sell is 2 months. An extension can be given for returning customers who have shown good standing with payment plans.In an effort to maintain fairness and ensure responsible financial commitments payment plans can be refused in cases where previous payment obligations have not been fulfilled or have been terminated, I regretfully cannot extend new payment plans if it becomes clear it will become a problem.

You will receive a simple shaded illustration ranging from knee up to fullbody. Artistic freedom slots includes 2 wips: 1 during the sketch phase and 1 during the flat color stage to ensure accuracy. During these stages you can only request change to things i have forgotten thats clearly depicted on the reference provided or color inaccuracies, but no change to pose or idea will be allowed. Thesecslots must be paid for no later then Friday evening and will be First come first served.
